Baptist Health MyChart Terms and Conditions of Use

Baptist Healthcare System, Inc. and its wholly controlled affiliates (“Baptist Health”) are pleased to provide its patients with access to the Baptist Health MyChart patient portal (“MyChart”).  MyChart is an internet-based application that enables a patient or their representative to have secure web-based access to portions of their Baptist Health electronic medical record, and allows a secure, convenient communications channel with Baptist Health for non-urgent messages.  Use of MyChart is optional.  Your continued use of this site will indicate your agreement to be bound by the Terms and Conditions set forth below. If you do not agree to be bound by these Terms and Conditions, do not use MyChart and exit this site.

Privacy

Your privacy is important to Baptist Health.  Baptist Health will use your confidential medical information in order to provide you health care services.  Baptist Health will, at all times, maintain your confidential medical information in strict confidence and will not disclose any information regarding you to any unaffiliated third-party unless you authorize that person to receive your information or the information is permitted to be disclosed by law.  Please review Baptist Health’s Notice of Privacy Practices for a thorough description of how we gather, use and protect your confidential medical information.  All messages sent and received within MyChart that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records.

MyChart Access

When you initially enroll in MyChart, you will be provided with an access code. The access code you receive will give you the opportunity to create a personal login name (called “MyChart ID”) and a password. Once this access code has been used it will no longer be valid. It is extremely important that you keep your login name and password completely confidential. Anyone with access to your login name and password will be able to access your confidential medical information.  That person will also be able to read your messages and send new messages as if they were you. It is your responsibility to prevent disclosure of your login and password, and to change your password if you feel that your security has been compromised. You may change your password at any time.

Secure Communications

All communications between you and Baptist Health using MyChart occur over a secure connection. You will receive e-mail messages notifying you that new information is available in your MyChart account.  This means that any person with access to your e-mail will be able to see this notification.  In order to prevent the receipt of emails by persons other than you, please provide a valid email address to which only you have access.  Although no confidential medical information will be sent, the notification that new medical information is available by accessing MyChart may be information that you would not want others to know.  Thus, you should take this into account when providing an e-mail address.  Please know that if you send us an e-mail communication, it may be shared with the Baptist Health staff that assists the physician in providing your medical care. Your confidential medical information on MyChart will be accessible only to appropriate clinical staff.

Baptist Health places considerable emphasis on the privacy of patient information and their compliance with applicable state and federal privacy laws. MyChart is configured to be secure from unauthorized access, but the Baptist Health cannot be held responsible for: a) unauthorized disclosures resulting from a user not logging out of an active session; b) unauthorized disclosures resulting from a lost or stolen user ID and password; c) unauthorized disclosures resulting from information printed by the user from MyChart; d) unauthorized disclosures resulting from personal computer settings or installed software products that may compromise information security; or e) similar events outside the control of the Baptist Health.

Electronic Messaging

MYCHART SHOULD NEVER BE USED FOR URGENT MATTERS. The anticipated turnaround time for a response to electronic messages is one to two business days. Therefore, for all urgent medical matters, please contact your physician’s office by phone, go to an emergency room, or dial 911.  If your provider is out of the office or unavailable, messages sent via MyChart may be routed to other authorized caregivers within Baptist Health in order to facilitate a timely response to your request.

Information Does Not Constitute Medical Advice

Baptist Health assumes no responsibility for how you use the information you obtain from this site.  You should consult with a physician or other health care provider regarding your own condition and how this site content may or may not apply to you.  Please note the medical or health care information provided in MyChart is not a replacement for proper medical attention or a substitute for appropriate and timely contact with your physician.  Please contact your physician, an emergency room, or 911 services immediately if you are suffering from urgent medical issues. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.  The electronic medical record is the property of Baptist Health and the information displayed in MyChart may not be the complete medical record.  Contact Baptist Health directly for official copies of your medical record.

Accuracy and Integrity of Information

Although Baptist Health attempts to ensure the integrity of the site, it makes no guarantees whatsoever as to the correctness or accuracy of the site. It is possible that the site could include typographical errors, inaccuracies or other errors. In the event that an inaccuracy arises or if there is a discrepancy with the medical information listed in your record, please inform Baptist Health so that it can be corrected. Information contained on the site may be changed or updated without notice.  Information in MyChart is provided “as is” without warranty of any kind and is meant for use only to support your relationship with your current or future medical professional. Your reliance on the material in MyChart is at your own risk. 

Proxy Access

A parent or legal guardian of a minor child up to the child’s 13th birthday or individuals age 18 or older may request proxy access to another individual’s MyChart account by completing the MyChart Authorization for Proxy Access and submitting it to Baptist Health.  A MyChart account will be activated for both the proxy and the account holder. If the proxy’s legal relationship with the account holder changes or you desire to modify the proxy access described herein, Baptist Health should be immediately notified by calling Baptist Health Release of Information at (502) 253-4820, or sending written notice to Baptist Health Release of Information, 2600 Stanley Gault Pkwy., Suite 101, Louisville, KY 40223. Baptist Health reserves the right to revoke proxy access at any time for any reason.

Appropriate Use and Termination of Access

Baptist Health may restrict or terminate access to MyChart at any time.  If access is restricted for planned maintenance of the MyChart system, every effort will be made to communicate downtime to all users in advance.  However, there may be reasons to restrict access to MyChart without advance notice.  Access to the MyChart system is granted to users for the purpose of furthering their medical care. Use of the system unrelated to this purpose may result in the suspension or termination of access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled and other activities that are deemed to cause a disruption to operations in the sole discretion of Baptist Health.  If your use of MyChart violates these Terms and Conditions, Baptist Health reserves the right to permanently terminate your access to MyChart. 

Restrictions on Use and Ownership

All pages within this site and any material made available for download are the property of Baptist Health and/or its subsidiaries and affiliates.  The content on the site is provided for Baptist Health and its patients only.  The words “Baptist Health” and its associated corporate logo are the trademarks and service marks of Baptist Healthcare System, Inc. or its affiliates  All other trademarks, service marks, and logos used in this site, including but not limited to MyChart and Epic, are the trademarks, service marks, or logos of their respective owners.  Nothing on this site should be construed as granting any license or right to use any trademark, service mark, or logo displayed on this site without the express permission of Baptist Health or the third party that may own the trademark, service mark, or logo.

Baptist Health makes no representations whatsoever about any other web site that you may access through this site or any entity that may post its advertisements on this site. Other Terms

Baptist Health shall not be liable for any damages suffered by the user or other third parties related to, directly or indirectly, the material and information contained in MyChart. In no circumstances will Baptist Health be liable to you or any other person for direct, indirect, special, incidental or consequential damages of any type, even if informed of the possibility of such damages. Baptist Health cannot guarantee access to the MyChart system and is not liable for your inability to access or view the information contained on the site. By downloading or viewing the information on MyChart, you agree to hold Baptist Health harmless and indemnify them against any damages, claims, or other claims asserted against Baptist Health arising out of, or in any way connected with, your utilization of MyChart or the information contained therein.  These Terms and Conditions shall be governed by the laws of the Commonwealth of Kentucky.
